In a recent case, our firm successfully represented a client with a terrible driving history who faced legal consequence after making a left turn on a red arrow. Pulled over by the police, the client was at risk of incurring a fine and potential licence suspension, further complicating her ability to fulfill parental responsibilities.
During the proceedings, we highlight the necessity of our client maintaining her driver’s licence, particularly in light of her obligations as a mother. Her two sons, both diagnosed with extreme ADHD requires regular psychiatric appointments, and the ability to transport them was crucial for their well-being. Presenting these circumstances to the Magistrate, we argued that a licence suspension would cause undue hardship, significantly impacting her family’s stability and access to necessary medical care for her children.
As a result, the court granted our client a favourable outcome under section 10(1)(a) Crimes (Sentencing Procedure) Act 1999. Her traffic violation and the associated fine were dismissed, allowing her to retain her licence. This decision brought significant relief to our client, ensuring she could continue supporting her children without additional legal impediments.
