A Sentencing Assessment Report (SAR) is a formal document prepared by Community Corrections, part of Corrective Services NSW, to assist the court in determining an appropriate sentence for an offender. It provides verified information about the offender’s background, criminal history, and suitability for various sentencing options, including community-based orders.
A SAR may be ordered by the court following a plea of guilty or a finding of guilt. To prepare the report, a Community Corrections Officer will interview the offender and collect information relevant to the court proceedings.
The report includes a risk assessment and recommendations regarding the offender’s suitability for supervision or participation in community service. Specifically, the report addresses:
- sources of information relied upon
- the offender’s current personal circumstances relevant to the offence
- risk of reoffending
- factors contributing to the offending behaviour
- factors affecting the offender’s capacity to engage in rehabilitation (e.g. intervention programs)
- how supervision would address the identified factors and whether suitable resources are available
- conditions necessary for effective community supervision
- the offender’s suitability for community service work
- any previous response to community-based supervision
- any additional matters the Magistrate directs to be addressed.
If the assessment is for the purpose of considering a home detention condition, the report must also address:
- the offender’s suitability for home detention
- any risks associated with the imposition of home detention
- any other relevant considerations.
Such a report cannot be finalised unless the offender has access to suitable accommodation.
In summary, a Sentencing Assessment Report is ordered by the court to assist in deciding what sentence is appropriate in light of the offender’s personal circumstances, risk factors, and rehabilitation prospects.
